On Wednesday, the U.S. Supreme Court denied a request from the Department of Justice (DOJ) to reinstate the Saving on a Valuable Education (SAVE) Plan. Recall that the DOJ filed an emergency appeal with the U.S. Supreme Court asking for the SAVE plan to be reinstated after the Eighth Circuit Court of Appeals issued an order blocking the plan and implicating income-driven repayment plans other than SAVE. In the unsigned order, the Supreme Court stated that “The Court expects that the Court of Appeals will render its decision with appropriate dispatch.” DOJ is expected to appeal the case on the merits if the Eighth Circuit rules against the government and invalidates SAVE.
