Our Commitment to Your Privacy

AccessLex Institute® ("AccessLex") is a nonprofit member organization underpinned by nearly 200 American Bar Association-approved nonprofit and state-affiliated law schools. AccessLex is intently dedicated to fostering broad-based access to quality US-based legal education and works to maximize the value and affordability of a US-based law degree through policy advocacy, research, and student-centered initiatives. AccessLex, along with its affiliates and subsidiaries, is referred to in this Privacy Policy as the "Company".

The Company values your privacy and is committed to maintaining the security and confidentiality of your information. In particular, we do not sell your personal information to make a profit. Our primary goals in collecting personal information are to optimize your online experience and advance the Company's broad, nonprofit, and student-centered mission (the "Mission"). Any marketing initiatives that we may conduct occasionally, either by ourselves or in concert with our business partners, such as nonprofit educational institutions, are solely to promote and facilitate the Company's Mission.

Information That We Collect – Information You Provide

The Company collects personal information about you when you provide it through this website and related pages, including but not limited to accesslex.org and Ask EDNA! (collectively, the "Site"). Personal information is any information about an individual from which that individual can be identified. Your name, address, phone number and location are examples of personal data.

The Company collects personal information when you interact with the Site and complete online forms, fields or surveys, create an account, or use the learning management software or tools offered through this Site. Personal information also includes information about your engagement with the Site and your progress towards completion of course or program materials. We also collect personal information about you if you contact us.

If you register for access to the learning management tools offered through https://askedna.accesslex.org/ (the “Ask EDNA! Site”), you will be required to provide your name, address, and email address. You may be asked to provide your telephone number, nickname or social media handle, information about your employment and education, your grades, and/or your Bar Exam score. The Company may also endeavor to obtain your Bar Exam score or related academic information from public sources, or, if permitted and appropriate, from your educational institution. Additionally, you may be able to upload certain limited content to the Site, such as comments, notes, feedback, photos, or completed assignments. If you provide us with this type of personal information through this Site, we will collect it and use it as outlined in this Privacy Policy.

Finally, if you stop by a Company booth or table at your school or at a related organization, during an event or otherwise, you may be asked if the Company representative can take your photo, either by yourself or as part of a group. By agreeing to pose for the photo, you permit the Company to use the photo, including your likeness, for limited promotional purposes, such as social media postings. However, under no circumstances will your photo or likeness be sold to any other party.

How We Use Your Information

Consistent with our Mission, the Company, along with our business partners, will use your personal information for the primary purpose of advancing cost-effective access to legal education and otherwise advancing the Company’s Mission. We also will use your information to improve your experience using this Site, and the products and services offered by the Company.

Your personal information may be used by the Company in the following ways:

  • Conducting general day-to-day business activities;
  • Developing and marketing new products or services;
  • Communicating with you (including communications from our business partners and affiliates) about the Company's products and services, or about products and services that may be of interest to you, consistent with the Company's Mission;
  • Responding to your inquiries or requests, or communicating with you about your Site account;
  • Sharing your personal data, or Site and/or Program usage data, with law schools, law professors, or consultants or other third parties working on the Company’s behalf, as part of initiatives to promote the Company’s nonprofit Mission;
  • Monitoring compliance with and enforcing the Site's Terms of Use, and otherwise protecting the safety of Site users and the integrity of the Site;
  • Preventing fraud or potentially illegal activities (such as copyright infringement);
  • Providing Site technical support or similar assistance; and
  • Aggregating information about you, and others like you, to utilize for analysis, research and similar purposes, consistent with the Company's Mission.

It is possible that the Company's corporate structure might change, or that portions of our nonprofit business might be acquired by another entity. In such transactions, customer information generally is a shared and transferred business asset.

By providing your personal information to us, you authorize the Company and its business partners to contact you, including through the use of automated technology. If we receive a Court Order or a subpoena for your personal information, we will disclose it as required by law. We may disclose your personal information as otherwise required by other legal mandates, or for the prevention or detection of a crime. We also may share your information with third parties that you have specifically designated as authorized to receive information from us. If you access the learning tools available through the Ask EDNA! Site in your capacity as a student of an educational institution with which the Company has a business relationship, the Company may provide your personal information to that institution. Finally, we may anonymize your information for research and analytical purposes, in which case the information will cease to be personal. We may share anonymized information with third parties for research purposes.

We do not disclose your personal information for profit to anyone. Similarly, we do not host third-party advertising on the Site. However, we may work with third-party vendors that may show you ads for Company products when you are browsing the internet. If you do not want your information to be used as described herein, you should not use this Site. Additionally, in light of the US-based focus of our Mission, if you are a resident of Canada or the European Union, you should not use this Site or provide any personal information through this Site.

Opting-Out of Information Sharing

You have the right, at any time, to opt-out of receiving marketing communications from the Company. Specifically, if you receive a marketing email from the Company, follow the "unsubscribe" instructions provided in the e-mail. If you sign up to receive text messages from the Company but no longer wish to receive them, follow the unsubscribe instructions in the text messages, or text "STOP" in response to such texts.

Helix Bar Review, Inc.

Helix Bar Review, Inc. (“Helix”), is a nonprofit affiliate of AccessLex. If you navigated to this Site in connection with your use or review of Helix of products or services, we encourage you to review Helix’s privacy policy and terms of use, which are substantially similar and are incorporated herein.

Additional Information – Hosted Website

The content and materials on the Ask EDNA! Site are hosted by Docebo, NA., Inc. ("Docebo"). Because Docebo is acting solely as a service provider for and on behalf of the Company, Docebo will not sell or share your information with anyone, except as required by law or as needed to provide services to the Company. Similarly, Docebo will not send you any marketing materials. Docebo will collect your information to ensure the security of the Ask EDNA! Site, and to otherwise host and optimize it.

Examples of other service-provider only Web Providers for Company websites are Cvent and On24 (for event-related websites), and Influitive (for Champions-related websites).

Web Providers; Website Usage Information; IP Addresses, Cookies and Metadata

The Company offers certain programs and services through third party website or app providers, website operators, and website service providers (collectively, “Web Providers”) which host or otherwise operationalize the Company’s online content and/or log-in experience.

While the Company makes reasonable efforts to minimize data collection by and through these Web Providers, the Company does not exercise control over the privacy practices of such entities in every instance. Because of this, the Company encourages you to review the privacy policies of each of these entities for additional information regarding how your personal information may be collected and used by them. These Web Providers include, but are not limited to Google, Qualtrics, Gallup, and Elsevier/Digital Commons/bepress.

As with many other websites, the Web Providers used to operate the Site may collect certain data pertaining to you and the equipment and communications methods that you use to access the internet and the Site. The Company, (along with Web Providers), may also collect general Site usage information, including, but not limited to IP addresses (or similar identifiers) of the devices used to access the Site, or geotracking information about your location. Generally, such information is used for Site maintenance and security. However, some website services like Google’s “captcha” service, impose their own privacy practices, and we encourage you to review them.

The Company or its Web Providers may also use "cookies" or other similar technologies when you visit the Site. Cookies are data files stored on your computer or device for a variety of reasons, including to track information about you, such as when you are logged on to the Site or to identify your preferences. Where possible, you may have the option to set cookie preferences. Otherwise, by using the Site, you consent to the use of cookies and similar tracking methods. At this time, the Site does not recognize automated browser signals regarding tracking mechanisms, which may include "do not track" instructions.

In addition, the Company (including its Web Providers) may retain the content of, and the metadata regarding, any correspondence you may exchange with us, regardless of the mode of communication by which such correspondence was made. This information helps us to improve the Site and the online media, content, materials, opportunities, and services that we feature or describe on the Site, and to more effectively and efficiently respond to both current and future inquiries.

Your continued access to and use of the Site represents your consent to the provisions of this Privacy Policy, and to the provisions of the privacy policies of each respective Web Provider, to the extent applicable.

The Site may contain links to third party websites as a convenience, or to provide you with additional information and functionality, such as payment processing options, which the Company does not manage directly. By offering hyperlinks to third party websites, the Company does not represent or imply that there is any relationship between it and any third party, or that the Company is endorsing these third parties, or their products or services. The Company makes no representations about, and is not responsible for, the privacy policies, if any, of any such third parties. Finally, the Company does not represent or promise that third party sites accessed through hyperlinks on this Site are free of viruses, worms, Trojan Horses or other code with destructive properties.

How You Can Access or Correct Information/How to Contact Us

Access to certain personal information that is collected through this Site may be available to you. For example, if you register for an account through the Site, you can access that account to review, change, delete or update the information that you provided previously.

A Special Note About Children's Privacy

You must be at least 18 years old to use this Site. The Company does not knowingly collect, use or disclose any information about visitors under the age of 13. We expressly reserve the right to update or amend this Privacy Policy from time to time. All such updates and amendments are effective immediately. We will provide you with notice of any amendments/updates by any reasonable means, such as posting a revised version of the Privacy Policy on the Site. You should view this Privacy Policy periodically to stay informed of changes that may affect you, as your continued use of the Program (as defined in the Terms of Use) signifies your continuing consent to be bound by this Privacy Policy, including any updates and amendments as noted above.
